This petition has been filed under Section 528 BNSS (482 Cr.P.C.) for quashing the order dated 17.11.2021 passed by the learned Judicial Magistrate First Class, Bhiwani in FIR No. 0055 dated 22.02.2018 U/s 379 I.P.C (303 BNS) registered at police station Bawani Khera, District Bhiwani vide which petitioner has been declared as a proclaimed person. 2.

Learned counsel for the petitioner submits that the petitioner had suffered from Hepatitis B and C (Black Jaundice) serious liver disease and got admitted in Civil Hospital, Kaithal and thereafter, he got admitted in PGI Rohtak and was about to die. Consequently, he could not appear before the learned trial Court. As such, he was declared as proclaimed person vide order dated 17.11.2021 (Annexure P-2). Learned counsel for the petitioner further prays that the petitioner is ready and willing to join the proceedings before the Court and prays that the impugned order be set aside. 3.

I have heard the submissions made by the learned counsel for the petitioner and gone through the case file. 6.

In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 17.11.2021 passed by the learned Judicial Magistrate First Class Bhiwani, However, in case the petitioner surrenders before the trial Court within next 07 working days from today and moves an application for grant of regular bail, the same shall be considered and decided by the Court concerned within a perid of three days.

The petition stands disposed of.
