Learned counsel for the petitioners submits that petitioners have married on 17.03.2017 at Arya Samaj Mandir, Gr. Noida (Regd) at Greater Noida (UP) against the wishes of respondents No. 5 to 7, parents and other relative of petitioner No2.

Admittedly, petitioner No.2 Poonam is less than 17 years of age as per her Secondary Examination Certificate (Annexure P-2). Marriage with a girl less than 18 years is an offence under the provisions of Prohibition of Child Marriage Act, 2006.

Learned counsel for the petitioners has limited his prayer for direction to respondent No.2 for taking appropriate action in accordance with law on the representation dated 18.03.2017 (Annexure P-3) submitted by the petitioners.

In view of the submission of learned counsel for the petitioners, but without expressing any opinion on the validity of their marriage, this Sachin Mehta 2017.03.22 16:54 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH

CRM-M-9845-2017 -2petition is disposed of with direction to respondent No.2-Commissioner of Police, Guru Gram (Gurgaon) to look into the representation 18.03.2017 (Annexure P-3) and take appropriate action in accordance with law. He is also directed to initiate legal proceedings as per provisions of the Prohibition of Child Marriage Act, 2006 against petitioner No.1 and others responsible including Purohit of Mandir, who got the marriage conducted. However, it is made clear that this order will have no effect on any civil or criminal proceedings instituted or intended against petitioners. (SURINDER GUPTA) March 22, 2017.
