(Oral) This is the second petition filed by the pettioner under Section 439 Cr.P.C. for grant of regular bail pending trial in case FIR No. 114 dated 25.8.2021, under Sections 21 and 22 of the NDPS Act, 1985, registered at Police Station Shimlapuri, District Ludhiana.

The counsel for the petitioner after arguing for some time realising that earlier petition was dismissed on merits and on failure to show change in the circumstances, in order to avoid adverse order, seeks permission to withdraw the present petition.
