Challenge in the present petition filed under Article 227 of the Constitution of India is to the order dated 08.05.2024 passed by the learned Civil Judge (Junior Division), Hoshiarpur.

Learned counsel for the petitioner would contend that, at this stage, he limits his prayer and would be satisfied if a direction is issued to the Trial Court concerned to decide the application for stay which is to be filed in the application under Order IX Rule 13 CPC filed for setting aside the ex parte decree dated 10.05.2019.

In view of the above, the present petition is disposed off with a request to the Trial Court concerned to decide the application for stay in case the same is filed before the next date of hearing i.e. 31.05.2024 in the application under Order IX Rule 13 CPC pending before it.
