(ORAL) The petitioner has preferred this writ petition for the issuance of an appropriate writ in the nature of mandamus, directing the respondents to release the retiral benefits of the petitioner viz. amount of gratuity which has been withheld by the respondent along with the interest.

Learned counsel for the petitioner submits that no charge-sheet was ever issued to the petitioner during his entire service tenure. The petitioner has retired on 31.03.2022 after rendering more than 31 years of satisfactory service. As per Government instructions, the retiral dues have to be released after processing the same within a period of three months from the date of retirement. 2023:PHHC:078787 CWP No.12038 of 2023 -2has been withheld for which the petitioner has already espoused his cause by way of legal notice dated 20.04.2023. At this stage, learned counsel for the petitioner submits that the petitioner would be satisfied in case his legal notice dated 20.04.2023 is directed to be considered by the respondent No.3 in accordance with law in a time bound manner.

Notice of motion.

On the asking of the Court, Mr. Sanjeev Soni, Advocate appears and accepts notice on behalf of the respondent No.3 and submits that the legal notice dated 20.04.2023 issued by the petitioner shall be considered and decided in accordance with law preferably within a period of one month from the date of receipt of certified copy of this order. Disposed of accordingly.
