Present writ petition has been filed by the petitioner namely Parkash Ram, aged 53 years, for quashing of the impugned order/recommendation dated 08.02.2023 (Annexure P-9), passed by learned Committee constituted by the Competent Authority, whereby the petitioner has been denied for his re-enrolment in the service as Home Guard Volunteer (HGV).

Counsel for the petitioner very fairly submits that against the said order, some of the ex-HGVs have filed the writ petitions, but the petitioner herein has chosen to file the statutory appeal before learned Appellate Authority, and the same is pending for adjudication before learned Appellate Authority, under The Punjab Home Guards Act, 1947, (respondent No.3) (appended with the present writ petition as Annexure P-11).

Therefore, counsel for the petitioner submits that he would be well-satisfied qua his claim, at this stage, if the said appeal dated 20.10.2023 (Annexure P-11), is decided in some time bound manner. Mr. Tanmoy Gupta, Advocate, who is present in the Court, on advance notice, puts an appearance on behalf of the respondents, and raises no serious objection, if the direction is issued to decide the appeal dated 20.10.2023 (Annexure P-11), filed by the petitioner, within some time bound manner.

Considering the submissions addressed by counsel for the petitioner, this Court deems it appropriate to dispose of the present writ petition, with a direction to Home Secretary, UT Chandigarh-cumAppellate Authority, under The Punjab Home Guards Act, 1947, (respondent No.3), to decide the said appeal dated 20.10.2023 (Annexure P-11), filed by the petitioner, by passing a speaking and well-reasoned order, after affording opportunity of hearing to the petitioner, within a period of 4 months from the date of receipt of the certified copy of this order, and any final decision taken thereon, would be duly informed to the petitioner, at the earliest.

With the reasons recorded here above, present writ petition stands disposed of.
