Petitioner has filed this petition under Section 482 read with Section 407 Cr.P.C. against respondent Axis Bank Ltd. for transfer of criminal complaint No.NACT/4829/2016 dated 17.05.2016 titled as 'Axis Bank Ltd. vs. Harjinder Singh and others' under Section 138 read with Section 142 of the Negotiable Instruments Act and also read with Section 420 IPC pending before learned JMIC, Ludhiana to any other court nearby District Bathinda having competent jurisdiction. I have heard learned counsel for the petitioner and have gone through the record.

The petitioner is stated to be of 25 years. Learned counsel for the petitioner contended that petitioner is ill and cannot travel from Bathinda to Ludhiana, therefore, his complaint case under Section 138 of VINEET GULATI 2019.05.31 16:58 I attest to the accuracy and authenticity of this document Chandigarh the Negotiable Instruments Act be transferred from Ludhiana to Bathinda.

CRM No.M-25415 of 2019 -2Learned counsel for the petitioner has placed some medical documents. The perusal of the medical record of the private hospital shows that petitioner was complaining of vomiting and nausea and was advised rest for 5 days on 12.01.2019. There is no document to show any serious illness or anything. In these circumstances, no ground is made out for transfer of the case.

Therefore, finding no merit in the present petition, the same is dismissed.
