Petitioner has preferred this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case bearing FIR No.0622 dated 03.09.2017 under Sections 148, 149, 323, 341, 506 IPC registered at Police Station Sadar Nuh, District Nuh. Petitioner was granted regular bail on the same day when he was presented before the trial Court. On 26.02.2020, an application was filed by the petitioner for exemption on the ground that he was busy in treatment of his aunt. The application was dismissed.

CRM-M No. 32187 of 2021 -2Perusal of order dated 26.02.2020 would show that the application for exemption was wanting on material particulars. On earlier date, direction was issued by the trial Court that no exemption application of the accused shall be entertained except prior approval of the Court. No prior approval of the Court was taken. The application was dismissed. Bail was cancelled and bail bonds were forfeited to State. Non-bailable warrants were issued against the petitioner for 03.06.2020 besides issuing notice to the surety and identifier. The aforesaid order was passed on 26.02.2020, however, the present petition has been filed on 06.08.2021 i.e. after about 01 year 05 months.

No ground is made out to entertain this petition. Dismissed. However, petitioner would be at liberty to surrender before the trial Court and seek regular bail in accordance with law.
