******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.61 dated 17.04.2016 registered for offences punishable under Sections 379-A and 506 of Indian Penal Code, at Police Station Haibowal, Ludhiana City, District Ludhiana.

Heard.

Learned State counsel submits that the petitioner was surety of accused-Pawan Kumar, who had absented and notice was issued to him. Due to non-appearance of petitioner, his warrants were issued. Now accused-Pawan Kumar has put in appearance before the trial Court, as such, custody of petitioner is no more required.

In view of submission of learned State counsel, the instant petition is allowed and order dated 22.02.2018 is made absolute. Petitioner will appear before the trial Court within a period of two weeks for further necessary action under Section 446 IPC if proceedings in this regard have been initiated against him.
