After arguing for sometime learned counsel has made a limited prayer. He has said that the petitioner is not in a position to make the payment of interim maintenance as ordered and is sanguine that would be able to prove this fact after evidence is before the Court but the main application has now been pending for almost 2 1⁄2 years and a direction be issued to the trial court to expedite the final disposal of the main application. Learned counsel states that on his part the petitioner would conclude his entire evidence on two effective opportunities and would not seek any adjournment for cross examining any witness produced by the prosecution. Keeping in view the above statement I deem it appropriate to direct the trial court to decide the main application on or before 31.03.2016. CRR(F)-196-2015(O&M) /"/ further undertakes that the petitioner would deposit the entire arrears of interim maintenance on or before 30.09.2015. Petition stands disposed of in the above terms.
