The petitioner - Ashi has filed the instant petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No. 0037 dated 06.05.2023 under Section 306 of IPC, Police Station Naya Gaon, District SAS Nagar (Annexure P-1).

The facts of the case are that Seema (sister of the deceased victim) gave her statement to the police that her sister Nandini got married with Karan Dogra in the year 2018. It was their love marriage. Out of this wedlock, Nandini had a child. During her stay in the matrimonial home, she was maltreated by her husband Karan Dogra and mother-in-law Ashi Dogra. The matter was pacified with the intervention of their brother-inlaw. However, on 05.05.2023 at about 10:15 P.M., she received a message from brother-in-law Jaspreet Singh that Nandini Dogra committed suicide by hanging herself from the ceiling fan. 2023:PHHC:081676 CRM-M-27490-2023 -2Kharar where the dead body of Nandini Dogra was lying. It is stated that her sister ended her life due to the maltreatment and mental torture caused to her by her husband Karan Dogra and mother-in-law Ashi Dogra. 3.

Learned counsel for the petitioner argued that all the allegations levelled against her are false. She is the mother-in-law and taking care of a small child. She will join the investigation as and when required. It is prayed that her anticipatory bail petition may be allowed. 4.

The bail petition is opposed by learned State counsel. Detailed status report is already filed. It is argued that there are specific serious allegations against the present petitioner. Considering the gravity of offence, the petitioner is not entitled to be release on anticipatory bail. 5.

I have considered the arguments and have gone through the record carefully. As per the contents of FIR, the marriage of deceased victim took place with Karan Dogra in the year 2018. They had a small child. The occurrence took place on 05.05.2023 in the matrimonial home where the deceased victim died unnatural death. The FIR is registered on the statement of Seema (sister of the deceased victim) where she has levelled specific allegations of maltreatment against Karan Dogra and his mother Ashi Dogra, the present petitioner. The petitioner is yet to join the investigation. Considering the gravity of offence, I do not find a fit case for grant of anticipatory bail to the petitioner - Ashi and the same is accordingly, declined.
