Through the present petition filed under Section 439 Cr.P.C., the petitioner seeks regular bail in case FIR No.25 dated 31.01.2017, registered under Sections 148, 149, 323 & 324 IPC and Section 3(1)(X) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, at Police Station Narnaund, District Hisar. Seeking regular bail for the petitioner, learned counsel submits that the petitioner has been in custody since 31.1.2017; there is no other criminal case pending against him and even if the averments made in the FIR are accepted as the gospel truth, which the petitioner does not admit, only a simple injury has been attributed to him. Criminal Misc. No. M-9991 of 2017 Having considered the submissions made by learned counsel for the parties, this Court is of the considered view that petitioner deserves to be admitted to regular bail. Thus, present petition is hereby accepted and petitioner, namely Baljeet is directed to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Hisar.
Nothing said here-in-above shall be construed to be an expression of opinion on the merits of the case. If the petitioner is found indulging in any criminal act or misusing the concession of bail granted by this Court, it would be open to the State to seek cancellation of bail granted vide this order by filing an appropriate application before the competent Court/this Court.
