**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in FIR No. 165 dated 18.10.2016 registered at Police Station Baghapurana, District Moga under Sections 363, 366-A, 376-D, 372 IPC, Section 5/6 of Protection of Children from Sexual Offences Act, Section 3/5 of Immoral Traffic Act and Section 3 of the SC/ST Act.
Counsel for the petitioner contends that the complaint was lodged by the grandfather that his grand-daughter was missing and the girl was recovered after few days and after recovery the girl had named some other persons and not the petitioner but the petitioner was named by the co-accused and the prosecutrix has not supported the prosecution version and has turned hostile and the petitioner is in custody since 15.7.2017. Considering the above circumstances and without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to Gurpreet Singh Bhatia 2018.02.23 17:05 I attest to the accuracy and authenticity of this document chandigarh
