(Oral) This is a petition filed by the petitioner under Section 439 Cr.P.C. for grant of regular bail pending trial in case FIR No.30 dated 6.4.2022, under Sections 21 (b) of the NDPS Act, 1985, registered at Police Station Khamanon, District Fatehgarh Sahib.

As per the prosecution story, the petitioner was apprehended on 6.4.2022 while riding scooty bearing registration No. PB 49 C 6832. 50 grams of smack was recovered from him.

The learned counsel for the petitioner submits that it is a case of false implication. The petitioner is involved in the FIR due to his involvement in the other FIRs. Recovery is of non-commercial quantity. State Counsel opposes the prayer and submits that the petitioner is involved in four more cases.

The Counsel for the petitioner submits that two FIRs were of noncommercial quantity and in the third case, the petitioner was nominated on the basis of disclosure statements.

CRM-M No. 28767 of 2022 -2Without commenting on the merits of the case and considering the nature and quantity of the contraband recovered and that conclusion of investigation and trial is likely to take time, the present petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate It is clarified that observations made above shall not be construed as an expression of opinion on the merits of the case.
