(ORAL) Prayer in the petition under Article 215 of the Constitution of India read with Section 10 and 12 of the Contempt of Courts Act, 1971, is for initiating contempt proceedings against the deliberate and willful disobedience of the order dated 23.08.2018 (Annexure P-1) passed by this Court in CWP No.21107 of 2018 titled as "Ram Pal V/s The Karnal Central Cooperative Bank Ltd., Karnal and another".

Since this Court has directed the petitioner-Rampal in CWP21107 of 2018, to avail the remedy of appeal as per Rule 31 of the Haryana State Central Cooperative Bank Staff Service (Common Cadre) Rules, 1975, no cause of action survives in the present contempt petition and the same is disposed of as having been rendered infructuous. It is made clear that all the arrears/dues of the petitioner be paid

However, the Department shall be at liberty to withhold the gratuity till the decision of the appeal. In case, the aforesaid amount is not paid within a period of one month from the date of receipt of certified copy of this order, the concerned Officer, who is responsible for not complying with the order, shall be liable to pay costs of `25,000/- to the petitioner.
