**** RAJ MOHAN SINGH, J. (Oral) The Registry took objection on the petition in the light of earlier criminal miscellaneous filed by the petitioner in the context of fair investigation.
Husband of the petitioner - Raj Kumar died in the year 2017.
Grievance of the petitioner is that the police is not taking any action in order to ascertain the real cause of death of Raj Kumar. Earlier, CRM-M No.1516 of 2018 was filed for issuance of necessary directions to the police to conduct fair and prompt investigation in FIR No.307 dated 13.06.2017 and MOHMED ATIK 2021.11.02 13:28 I attest to the accuracy and integrity of this document
CWP No. 15549 of 2021 -2also to hand over the investigation to some police officer not below the rank of Deputy Superintendent of Police. The said petition was disposed of in the light of stand taken by respondent- State.
Now, the present petition has been filed under writ jurisdiction of this Court more or less for the same relief. Learned State counsel submits that after investigation, cancellation report has been prepared and the same shall be filed before the Illaqa Magistrate very shortly. There is no ground to entertain the present writ petition, however, as per the stand taken by learned State counsel, petitioner would be at liberty to avail her remedy on filing cancellation report in accordance with law. Disposed of.
