*** H.S. Grewal, J. (Oral)   This is the second petition filed under Section 439 of Cr.P.C. -1seeking regular bail in FIR No.54 dated 27.06.2022 under Section 21 of NDPS Act registered at Police Station Valtoha, District Tarn Taran. 2.

The case of the prosecution is that total 260 grams of Heroin has been recovered from the petitioner out of which 150 grams of Heroin was recovered from the possession of the petitioner on 27.06.2022 and 110 grams on 30.06.2022.

Vide order dated 11.03.2025 passed by the Coordinate Bench of this Court, the petitioner has been granted interim bail. 4.

Learned counsel for the petitioner contends that the petitioner has undergone custody period of 02 years, 08 months and 16 days and out of total 16 prosecution witnesses, only 05 have been examined so far. 5.

dated 16.08.2025 filed in Court today, the petitioner has undergone custody -2period of 02 years, 08 months and 16 days and that out of 16 prosecution witnesses, only 05 have been examined so far 7.

Keeping in view the facts and circumstances of the present case, the order dated 11.03.2025 granting interim bail to the petitioner is made absolute.

It is however, made clear that in case during his bail, the petitioner indulges in any offence, the State shall be at liberty to file an application for cancellation of bail of the petitioner.
