The present writ petition has been filed by the petitioner challenging the resolution passed by the Gram Panchayat to sell 50 acres of panchayat land to Bikaner B Power Transmission Limited (now Siwani Transmission Limited) at a lower rate than the price at which it was sold by private farmers.

Learned counsel appearing on behalf of respondent Nos.2 and 3 has brought to the notice of the Court that the brother of the petitioner, namely, Dinesh Kumar son of Sajjan Kumar, having the same residential address, had earlier filed CWP-828-2026 through the same very counsel, namely, Mr. Gulab Singh Narwal. In the said writ petition, on 19.01.2026, the following order was passed :

"Learned counsel for the petitioner seeks to withdraw this petition with liberty to the petitioner to pursue the civil suit already preferred by the petitioner.

Dismissed as withdrawn with liberty as prayed for." Thereafter, the applicant-petitioner therein, namely, Dinesh Kumar, filed a civil miscellaneous application (CM-3480-CWP-2026) for recalling of the order dated 19.01.2026 wherein the following order was passed : "Through this application, recalling of the following order of this Court dated 19.01.2026 is sought for : "Learned counsel for the petitioner seeks to withdraw this petition with liberty to the petitioner to pursue the civil suit already preferred by the petitioner.

Dismissed as withdrawn with liberty as prayed for." A perusal of the afore quoted order reveals that the applicant's main petition had been dismissed as withdrawn on acceptance of request made by his counsel. In the instant application, it is not denied that on 19.01.2026, learned counsel for the applicant/petitioner had prayed for withdrawal of the main petition, which prayer was accepted, resulting in the passing of the order quoted above.

In view of the above, no ground to recall the order of this Court dated 19.01.2026 is made out.

Learned counsel appearing on behalf of respondent Nos.2 and 3

has further pointed out that the petitioner herein has chosen not to divulge any of these details in the present writ petition which amounts to suppressio veri and suggestio falsi.

This Court was inclined to dismiss the petition with exemplary costs. However, at this stage, the learned counsel for the petitioner seeks permission to withdraw the present petition and prays that the costs be not imposed as the petitioner is a very poor person. 5.
