'(( 1/ " Learned counsel for the petitioner submits that initially, the FIR was lodged under Sections 323, 325, 148 and 149 of IPC and there was no specific role attributed to the petitioner of inflicting any injury, however, subsequently, Section 452 of IPC has been added and, therefore, it has necessitated for the petitioner to seek the concession of anticipatory bail. Notice of motion.

Mr. Siddharth Attri, AAG, Punjab, accepts notice on behalf of the respondent-State.

Learned State counsel, on instructions from ASI Harinder Pal submits that the main accused-Chandan, Harve, Ravinder and Davinder have already been arrested, however, could not deny the fact that as per the FIR there is no role or injury attributed to the petitioner and the petitioner has been nominated under Sections 148, 149 read with Section452 of IPC. Heard the learned counsel for the parties.

Considering the above and the fact that no recovery has to be effected from the petitioner, the petitioner is directed to join investigation on 06.06.2024 at 11:00 A.M. before the Investigating Officer and cooperate with the Investigating Agency, even thereafter.

In the event of arrest, the petitioner be released on interim bail subject to furnishing personal/surety bonds to the satisfaction of the Arresting/Investigating Officer and the petitioner shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C.

It is made clear that, in case, the petitioner is found involved in any such activity once again, the State is at liberty to promptly move an appropriate application for cancellation of bail detailing out the circumstances and violation of the condition(s) of bail.
