The petitioner seeks grant of anticipatory bail in a case registered vide FIR No.167, dated 29.8.2019, Police Station Sadar, District Patiala, under Sections 458, 323, 506, 34 IPC. 2.

At the time of issuance of notice of motion on 10.9.2020, the following order was passed :- "Learned counsel for the petitioner contends that all the injuries allegedly caused are simple in nature and that the petitioner in any case is not named in the FIR and is sought to be nominated as an accused on the basis of disclosure statement allegedly made by Mandeep Singh.

- 2 - CRM-M-27136-2020 (O&M) Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C." 3.

Learned State counsel upon instructions from ASI Davinder Singh has not disputed the fact that the petitioner has been nominated as an accused on the basis of a disclosure statement. He has further informed that pursuant to interim directions issued by this Court on 10.9.2020, the petitioner has since joined investiation and is not required for any custodial interrogation.

In view of the aforestated position, the petition is accepted and the interim directions issued vide order dated 10.9.2020 are hereby made absolute subject to the condition that the petitioner shall appear and join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
