Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.45 dated 05.03.2017 under Sections 323, 324, 307, 506 and 34 IPC, registered at Police Station Uchana, District Jind.
Learned counsel submits that petitioner is incarcerated since May 17, 2017. Trial is still at its initial stage. Learned counsel for the State has opposed the prayer for bail. Heard.
Keeping in view long incarceration of the petitioner and the fact that trial may take long time to conclude, no useful purpose would be served by detaining the petitioner any longer. Thus without expressing any opinion on the merits of the case, this petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Jind.
