This petition has been filed under Section 482 Cr.P.C. challenging the order dated 16.02.2004 (Annexure P-5) passed in case FIR No.112 dated 14.05.2003 under Sections 420, 467, 468, 471, 120-B registered at Police Station Ropar, District Ropar, whereby the petitioner has been declared proclaimed offender.

Learned counsel for the petitioner submits that on 29.05.2023, this Court has directed the petitioner to surrender before the learned trial Court within a period of six weeks. He further submits that the aforesaid period of six weeks has expired because the petitioner is residing abroad and it was beyond his control to come back due to medical reasons. On 08.08.2023, learned counsel for the petitioner submits that the petitioner is to come back India on 12.08.2023 and he again undertakes to surrender before the learned trial Court.

CRM-M-27537-2023 -2- "Learned counsel for the petitioner inter alia contends that the order dated 16.02.2004 (Annexure P-3) vide which the petitioner was declared a proclaimed offender does not comply with the provisions laid down under Section 82 of the Code of Criminal Procedure (for short 'Cr.P.C.'). Reference has also been made to the orders (Annexure P-2 and P-4) and it has been pointed out that a clear period of 30 days was not granted. He further submits that the petitioner is willing to surrender before the Court and face trial but apprehends that the moment he appears, he shall be taken into custody in view of the order dated 16.02.2004 (Annexure P-3). Notice of motion.

Mr. Dhruv Dayal, Additional A.G., Punjab accepts notice on behalf of the respondent-State.

In the meanwhile it is directed that if the petitioner surrenders before the trial Court within a period of six weeks from today, he shall be released on interim bail to the satisfaction of the Courtconcerned.

Thereafter, vide order dated 08.08.2023, the petitioner was again directed to surrender before the learned trial Court. On instructions from ASI Sanjeev Kumar, learned State counsel submits that in compliance of the aforementioned order, the petitioner has joined proceedings before learned Trial Court and has been released on bail. 5.
