The petitioner seeks grant of regular bail in respect of a case registered vide FIR No.167, dated 7.8.2020 at Police Station Mauli Jagran, U.T., Chandigarh under Section 20 of Narcotic Drugs and Psychotropic Substances Act, 1985. 2.
The petitioner is alleged to have been found in possession of 10 Kilograms and 100 grams of 'Ganja', which would fall within the category of 'noncommercial' quantity. 3.
The learned State counsel has, however, informed that the report of FSL is still awaited. The learned State counsel has informed that as per custody certificate furnished by Sh. Having regard to the nature and quantity of contraband allegedly recovered, which apparently falls within the category of 'non-commercial' quantity, and also the fact that the petitioner is not involved in any other case, the petition is accepted and the petitioner is ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
