CORAM:
HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. Jaspreet Singh Saini, Legal Aid Counsel.
Mr. Kirat Singh Sidhu, Deputy Advocate General, Punjab. *** Learned counsel for the petitioner has contended that since the petitioner has already undergone the sentence of two years imposed upon him by JMIC Sangrur vide judgment dated 25.1.2014 and as per order dated 21.04.2016, notice of motion has been issued by this Court limited to the extent qua factum of sentence only. Therefore, he has no other contention to raise.
Learned State counsel has placed on file custody certificate of the petitioner dated 29.9.2017 showing that on that date the petitioner had undergone total sentence of 1 year 11 months and 24 days. More than 2 months have lapsed since then. That means the petitioner has completed the sentence of 2 years in this case. Further more there is a delay of 249 days in filing of the Revision Petition, which has not been condoned so far. Keeping in view the fact that the petitioner has already completed the period of Parvinder Singh 2017.12.07 11:07 I attest to the accuracy and integrity of this document Chandigarh
CRR No. 473 of 2016 sentence in the form of rigorous imprisonment for 2 years, the Revision Petition has rather become infructuous and is disposed of accordingly. (H.S.
