The present petition under Section 483 of BNSS, 2023 for grant of regular bail to the petitioner in case FIR No.199 dated 15.11.2024, registered under Section 105 of BNS and 103 of BNS (Added later on), at Police Station City South, District Moga, Punjab.

Learned counsel for the petitioner as well as learned State counsel have been heard and material collected by the police during investigation has been perused.

As per prosecution case, complainant Ravinder Kumar was running a confectionery shop at Railway Road, Moga and three shops away, his brother namely Parmod Kumar was running a sweet shop. The shop of Suresh Kumar (petitioner) was adjacent to the shop of Parmod Kumar and next to his shop, godown of Parmod Kumar was there. On 14.11.2024, at about 04:00 P.M., Parmod Kumar went to his godown to keep some articles, when he found the bicycle of Suresh Kumar parked near his godown, on which he lifted the bicycle and placed it on the other side, which infuriated the petitioner-Suresh Kumar. CRM-M-24652-2025 (O&M) -2and abuses at Parmod Kumar and charged at him and gave fist blows, as a result of which Parmod Kumar fell on the ground and he was overpowered by petitioner Suresh Kumar. Thereafter, he again gave fist blows in his chest despite knowing the fact that some stent had been affixed in his heart and thereafter, Parmod Kumar fell unconscious. He was taken to hospital, where he was declared dead. Petitioner was arrested on 15.11.2024 and after completion of the investigation, final report was presented for trial.

Vide order dated 14.07.2025, the report of medical condition of petitioner was obtained from Jail Hospital, Faridkot on the basis of which he has already been released on interim bail and till date, he is continuing on interim bail. As per status report dated 07.10.2025 furnished by the State, the petitioner is undertreatment in Dayanand Medical College and Hospital, Ludhiana. As per medical certificate, he is fit to travel but needs one family member for activities of daily life and routine activities. As such, petitioner cannot take care of himself and needs an attendant.

Accordingly, in view of the above, without commenting on the merits of the case, the present bail application is allowed and the interim bail order dated 14.07.2025 vide which he was released on interim bail is made absolute till conclusion of the trial on the same terms and conditions. 6.
