The instant petition has been filed under Section 483 of the BNSS, 2023, for grant of interim bail to the petitioner in FIR No.305 dated 11.08.2024, under Sections 103(1), 115, 118(1), 118(2), 126, 190, 191(3), 351(2) of the BNS, registered at Police Station Tosham, District Bhiwani. 2.

On 05.05.2025, notice of motion was issued. Today, the Bar has declared "No Work Day" on account of prevailing circumstances. However, SI Ramesh Kumar, who is present in the Court today, has submitted a short reply dated 06.05.2025, by way of an affidavit of Sh. Dalip Singh, HPS, Deputy Superintendent of Police, District Bhiwani, which is taken on record. 3.

As per the reply, the verification of factum of marriage of sister of the petitioner has been done and the statements of village Sarpanch, Panch and co-villager Sumer have been recorded in this regard, as per which, the marriage of sister of the petitioner is scheduled for 10.05.2025. As per the reply, there is no other male member in the family of the petitioner. The petitioner has never been declared as Proclaimed Offender. As per the custody certificate dated 07.05.2025, filed in the Court today, the petitioner is also facing in another FIR No.183/2023, under Sections 323/325, 341, 506 IPC, registered at Police Station Tosham and FIR No.26/2024, under Sections 147, 148, 149, 323, 506 IPC, registered at Police Station Tosham. The petitioner is on bail in FIR No.183/2023. However, he is still facing trial in FIR No.26/2024. 5.

In view of the facts and circumstances of the case, the petitioner is ordered to be released on interim bail for a period of 05 days, subject to his furnishing personal bonds and surety bonds to the satisfaction of the CJM/Duty Magistrate, District Bhiwani. On the expiry of 05 days, the petitioner shall surrender before the CJM, Bhiwani at 10:00 AM. The period of 05 days shall be counted from the date of his release and the date of surrender of the petitioner is to be indicated by the trial Court. 6.

The present petition stands disposed of accordingly. 7.

Pending miscellaneous applications, if any, shall stand disposed of.
