The instant petition has been filed on behalf of the petitioner seeking grant of anticipatory bail in respect of aforementioned FIR. 2.

The FIR was lodged at the instance of Jaswinder Kaur wherein it is alleged that she had sent money to the petitioner while she was residing abroad for the purpose of purchasing property but the petitioner instead of purchasing property in the name of the

- 2 - complainant, purchased property in his own name with the help of the money sent by the complainant.

At the time of issuance of interim bail the following order was passed on 27.05.2024:

"Contends, inter alia, that prima facie, it is a civil dispute and Sale Deed dated 01.10.2020 has already been executed in favour of the petitioner.

Notice of motion.

On asking of the Court, Ms. Manjot Kaur, AAG, Punjab accepts notice on behalf of the respondent and seeks time to have instructions and/or file written response in the matter. Posted for 30.07.2024.

In the meanwhile, petitioner shall join investigation before the Investigating Officer. In the event of arrest, the Arresting Officer would admit him to interim bail in the present case, till the next date of hearing, on furnishing adequate bail and surety bonds to his satisfaction. The petitioner is also directed to abide by all the conditions as envisaged under Section 438(2) of the Code of Criminal Procedure, 1973."

Status report by way of affidavit of Mr. Dalbir Singh, Deputy Superintendent of Police, NRI Wing, Sub Division Jalandhar, has been filed. The same is taken on record.

Learned State counsel has submitted that the petitioner has joined investigation and is not required for any custodial interrogation. 6.

In view of the aforestated position wherein the petitioner has joined investigation and she is not stated to be required for any custodial

- 3 - interrogation, the petition is accepted and the interim directions issued by this Court vide order dated 27.05.2024 are hereby made absolute subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
