Present petition has been filed by the petitioner, seeking grant of anticipatory bail, in case, FIR No.15, dated 24.12.2024, under Sections 406, 420, 120-B of IPC (corresponding to sections 316(2), 318(4), 61(2) of BNS) and Section 24 of Immigration Act, registered at Police Station Economic Wing, UT Chandigarh.

On advance notice, Mr. Manish Bansal, learned Public Prosecutor for U.T., Chandigarh, puts an appearance on behalf of the respondent/State, and on instructions from ASI Amarjit Singh, submits that petitioner had already been declared a proclaimed offender; however, this fact was inadvertently not brought to the notice of learned Judge at the time when petitioner's anticipatory bail application was dismissed, vide order dated 21.04.2026 (Annexure P-5).

CRM-M-24523-2026 -2another case registered in District Zirakpur, wherein petitioner is presently lodged in Patiala Jail, he has not been produced by the Punjab Police, in compliance with the said production warrants. In view of the above, learned Public Prosecutor submits that present petition is not maintainable, as petitioner has already been declared a proclaimed offender, and since production warrants have already been issued, prayer for anticipatory bail in the present petition is not sustainable.

Faced with this situation, learned counsel for the petitioner seeks permission to withdraw the present petition, with liberty to avail appropriate remedies, available to him, in accordance with law. 6.

Accordingly, present petition stands dismissed as withdrawn, with the liberty as sought and recorded here above.
