HARPREET SINGH BRAR J. (Oral) Prayer in this petition is for issuance of directions to official respondents to complete the investigation and file charge-sheet in FIR No.09 dated 26.03.2019, registered under Section 221 of BNS, 2023, at Police Station Khemkaran, District Tarn Taran. Further prayer has been made to direct respondent No.2 to decide the representations dated 03.03.2023 and dated 28.04.2025, filed by the petitioner. Learned State counsel, at the very outset, submits that the veracity of the allegations made by the petitioner has been examined thrice and on all three occasions, after the conclusion of the investigation, cancellation report was submitted. The third cancellation report was submitted on 03.05.2025 and as such, the petitioner has an alternative remedy to pursue the same and the controversy can be decided by a jurisdictional Court by passing an appropriate orders in MOHD YAKUB 2025.05.06 17:20 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court at Chandigarh
CRM-M-24353-2025 terms of the judgment rendered by this Court in Pawan Kharbanda vs State of Punjab and another, passed in CRM-M No.3193 of 2025, decided on 29.01.2025.
In view of the above, learned counsel for the petitioner wishes to withdraw the present petition with liberty to invoke his alternative remedy, in accordance with law.
Dismissed as withdrawn with liberty aforesaid. The jurisdictional Court is directed to consider the cancellation report and pass appropriate order strictly in terms of the guidelines rendered by this Court in Pawan Kharbanda's case (supra), after affording adequate opportunity to the petitioner to file his written objections with regard to any shortcomings and bias in the investigation carried out by the investigating agency.
