(ORAL) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.31 dated 04.03.2019 registered under Section 376, 377, 354-A IPC and Section 4 of POCSO Act at Police Station Tibba, District Ludhiana.
Counsel for the respondent-State on instructions from ASI Gurdev Singh would submit that in fact out of 16 witnesses cited, 12 have been examined and 4 have given up. It is contended that Sections 376, 377, 354-A IPC along with Section 4 of POCSO Act have been invoked against the petitioner for offences committed upon an 11 years old girl. It is also contended that matter is at the fag end with only two witnesses left to be examined.
At this stage, learned counsel for the petitioner seeks to withdraw the instant petition.
Ordered accordingly.
