*** SURINDER GUPTA, J CRM-1670-2017 This is an application seeking permission to compound the offence punishable under Section 138 Negotiable Instruments Act. Learned counsel for respondent no.2 submits that he is not to file reply to the application but has instructions to submit on behalf of respondent no.2 that the entire cheque amount has been received and respondent has consented to compound the offence. The petitioner has also deposited 15% of the cheque amount with this court vide receipt no.317 dated 27.1.2017, photocopy of which has been placed on record. In view of the above, the instant miscellaneous application is Deepak Kumar 2017.01.30 16:35 I attest to the accuracy and authenticity of this document HIGH COURT, CHANDIGARH allowed.
Crl. Revision No. 4835 of 2016 -2CRR-4835-2016 The matter has since been compounded, as such, judgment dated 31.7.2015 passed by the trial court convicting and sentencing the petitioner for offence punishable under Section 138 of Negotiable Instruments Act and judgment passed by the first appellate court dated 10.11.2016 affirming the judgment passed by the trial court are set aside and the petitioner is ordered to be set at liberty forthwith, if not required in any other case.
Copy of this order be conveyed to Superintendent, District Jail, Kaithal where the petitioner is stated to be kept in custody. Disposed of accordingly.
