The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to grant five marks for Vimukt/Tarpriwas Caste and issue him appointment letter. 2.

The petitioner pursuant to advertisement No.3/2018 applied for the post of Constable. He applied under Scheduled Caste (for short 'SC') Category. He scored 42.4 marks in written examination. He was awarded five marks under socio-economic criteria. His total marks were 47.40 and cut off under SC Category was 51.40 marks. 3.

The petitioner is claiming that he belongs to Vimukt/Tarpriwas Caste, thus, is entitled to five marks under 10% weightage.

Learned State counsel submits that five marks were given to candidates belonging to Vimukt and Tarpriwas Caste which is neither a Scheduled Caste nor a Backward Class (for short 'BC'). The petitioner himself filed application form under SC Category. He on one hand is claiming selection under SC Category and on the other claiming five marks which are not available to SC and BC Category candidates. 5.

The stand of respondent seems to be justified. There is no representation of the petitioner.

Dismissed with liberty to petitioner to move an appropriate application within three months from today, if cause survives. 7.
