(ORAL) This is a petition that has been filed for grant of anticipatory bail to the petitioner in FIR No.24 dated 28.03.2021 under Section 498-A & 323 IPC registered at Police Station Ghuman, District-Gurdaspur. Counsel for the petitioner would contend that the petitioner herein has been falsely implicated in the said matter. It is submitted that marriage was solemnized between the petitioner and complainant on 25/29.04.2020 and after their marriage, it was the complainant herself who used to quarrel with the petitioner and his entire family members on petty issues. It is argued that the allegations of dowry made in the FIR are vague and general in nature as no details are given as to when and from whom demand of dowry was made and therefore, no case under Section 498-A IPC is made out. It is also argued that the present FIR has been registered as a counter blast to the petition that has been filed by the petitioner under Section 9 of HMA.

CRM-M No.32425 of 2021 (O&M) -2Learned counsel for the respondent-State opposes grant of anticipatory bail to the petitioner by contending that there is specific allegation against the petitioner that he gave severe beatings to the complainant due to which she got a miscarriage. The investigation is underway and therefore, the petitioner is not entitled for concession of bail. I have heard counsel for the parties and keeping in view the fact that apart from allegations of demand of dowry, there is specific allegation against the petitioner that he gave beatings to the complainant, which resulted in miscarriage. The investigation is underway and if the petitioner is granted concession of bail, there is every likelihood that he may hamper the investigation.

In view of the aforementioned facts, no ground is made out to grant anticipatory bail to the petitioner. Resultantly, the instant petition stands dismissed.
