CORAM: HON'BLE MR. JUSTICE ARUN MONGA Present :
Mr. Jasvir Singh Dhaliwal, Advocate for the petitioners.
Mr. Sidakmeet Sandhu, AAG, Punjab.
(Presence marked through video conference).
ARUN MONGA, J. (ORAL) Petitioners herein seek issuance of a writ in the nature of mandamus directing official respondents No.2 and 3 to protect their lives and liberty from the hands of private respondents. Petitioner no.1, a widow aged 66 years, is stated to be staying alone as her only son i.e. petitioner No.2 is currently serving in Indian Army and is posted at some far off place. She has thus no one to count on or turn to in case of any emergency.
Perusal of the record, particularly, compromise contained at Annexure P-2 reflects that there are/were some civil disputes also between the parties. Accordingly, no interference is called for under extra ordinary jurisdiction of this court. The petition is disposed of with liberty to the petitioners to seek their alternative remedies, as may be available, in accordance with law.
It is, however, made clear that disposal of the petition shall not be construed by the official respondents to overlook the representation dated 02.09.2020, Annexure P-3, submitted by the petitioners with regard to their threat perception, if any, qua the private respondents. Disposed of accordingly. (ARUN MONGA) SEPTEMBER 10, 2020 JUDGE vandana Whether speaking/reasoned :
