submits that the situation is other way around and all the gift articles received from the complainant side have been returned but the gifts given to the girl by the petitioner and their relative are not being returned by the complainant side. At this stage, this Court is not inclined towards the said recoveries of articles from both the parties.
In view of above, the petition is allowed. The petitioner shall join the investigation as and when called upon to do so by the Investigating Agency. In the event of arrest the petitioner shall be released on bail subject to the satisfaction of the Arresting Officer/Investigating Officer. However, the petitioner shall abide by the conditions of Section 438 (2) Cr.P.C. and is further imposed with the following conditions:-
1. That the petitioner shall made himself available for interrogation by a police officer as and when required to do so. That the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer. ! That the petitioner shall not leave India without prior permission to the Court.
