Mr. J.S. Dhaliwal, Advocate for the respondent. *** In the morning when the case was called Sh. Balwant Singh, proxy counsel had appeared on behalf of Mr. Sumati Jund, Advocate. The proxy counsel was asked as to whether the payment had been made in compliance with the order dated 30.5.2019, however, he showed ignorance in that regard stating that has no information in that respect and only counsel for the petitioner can provide the requisite information and he requested for a pass over stating that arguing counsel for the petitioner was busy before a coordinate Bench. Pass over was accordingly given and case was called again after some time. There was no representation on behalf of the petitioner. The case has been called for the 3rd time. Again nobody has put in appearance for the petitioner.

Learned counsel for the respondent has reiterated at the Bar the statement which he had made on the previous date of hearing i.e. 9.12.2022 that the direction relating to deposit of amount i.e. Rs.12,600/- per month from the date of last payment, has not been complied with since the date of PARVINDER SINGH 2022.12.22 15:19 I attest to the accuracy and authenticity of this document

CR No. 3712 of 2019 (O&M) passing of the order i.e. 30.5.2019.

A perusal of the record goes to show that on 10.10.2022 last opportunity was granted to the petitioner to comply with the order dated 30.5.2019 clarifying that in case of failure of the petitioner to do so the Court would take appropriate course on the adjourned date. The order in question does not seem to have been complied with and it has been specifically so stated by learned counsel for the respondent. It being so, the revision petition cannot proceed further and is accordingly dismissed for non-prosecution.
