******* SURINDER GUPTA, J.(Oral) This is second petition filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.782 dated 06.10.2015 registered for offences punishable under Sections 406, 420 of Indian Penal Code, at Police Station City Thanesar, District Kurukshetra.

Heard.

The petitioner was allowed pre-arrest bail by this Court vide order dated 18.08.2017 passed in CRM-M-22184-2017. After being released on bail, he absented from 02.05.2018 till date and applied for anticipatory bail on 14.05.2019 i.e. after a period of more than one year of his absence.

CRM-M-26331-2019 -2He has drawn my attention to the MRI report of the petitioner Annexure P4, which shows that all the parameters of brain parenchyma during MRI were normal. Later reports are of March, 2019, which are test reports and show no serious abnormality.

Keeping in view the above facts and circumstance and conduct of the petitioner, I do not find any reason to exercise the discretionary power of this Court to extend the benefit of anticipatory bail to the petitioner.

This petition has no merits. Dismissed.

However, on surrender of the petitioner before the trial Court, his bail application, if any, be disposed of expeditiously. ( SURINDER GUPTA ) July 01, 2019 JUDGE Sachin M.
