Mr. Tahaf Bains, Advocate for the petitioners. PANKAJ JAIN, J. (ORAL) Petitioners herein pray for issuance of a writ in the nature of mandamus directing the respondent-Corporation not to effect recovery from the petitioners pending decision on the appeal. Counsel for the petitioners submits that the appeal is provided under the statutory regulations and the petitioners have availed the said remedy by filing the appeal dated 18th of May, 2023 which is pending consideration.

Mr. Arjun Dhaliwal, Advocate appears for Ms. Deepali Puri, Advocate on advance notice on behalf of the respondents and submits that the appeal preferred at the behest of petitioner is pending consideration before the Appellate Authority and the same shall be decided within a period of four months.

Till then recovery on the basis of order dated 31st of March, 2023 shall remain stayed.
