CM No.8454-CII of 2021 Allowed as prayed for. Annexures P2 to P4 are taken on record. Main case This application has been filed by the wife to transfer the case No.210 of 2021 (Om Parkash vs. Ekta @ Rajni) from the Court of Principal Judge, Family Court at Barnala, to the Court of Principal Judge, Family Court at Panchkula.

The petitioner claims to be residing along with her two minor children at Panchkula and the distance between Barnala and Panchkula is 170 kms.

Learned counsel representing the respondent contends that the petitioner resides at Barnala and not at Panchkula. He has annexed certain ASHOK KUMAR 2021.09.15 15:56 I attest to the accuracy and integrity of this document

TA-705-2021 (O&M) documents to prove that fact. On the other hand, the petitioner has produced copies of the record from the school where her both children are at present studying. As per the aforesaid certificates, issued by the Principal, Government Model Sankriti Senior Secondary School, Sector 20, Panchkula, both the children are studying in that school. Keeping in view the aforesaid facts, the petition is allowed. The proceedings of case No.210 of 2021 (Om Parkash vs. Ekta @ Rajni) pending in the Court of Principal Judge, Family Court at Barnala, are ordered to be transferred to the Principal Judge, Family Court at Panchkula. The transferor Court is requested to remit the case file to the transferee Court forthwith. The parties are directed to appear before the Principal Judge, Family Court at Panchkula, on 04.10.2021.

All the pending miscellaneous application(s), if any, are also disposed of.
