* * * * The reference to the Labour Court was answered in favour of the workman and it was held that he is entitled to reinstatement with continuity of service and 40% back wages from the date of demand notice i.e. 25.08.2000. It was this order, which is challenged by the Department. The operation of the order was stayed vide order dated 18.01.2011. Representative of the Department now states that the workman has been taken back in service on 21.03.2016 and has been paid the back wages as per the award and consequently, submits that the writ petition be dismissed as not pressed.

In view of the stand of the department, the writ petition is dismissed having been rendered infructuous.
