Apprehending his arrest in FIR No.0066 dated 05/09/2022 (Annexure:P-1), registered under Section 279, 308, 337,338 IPC (corresponding Section 281,110,125 BNS) and Section 61 of Punjab Excise Act, registered at Police Station Chamkaur Sahib, District Rupnagar; the petitioner has preferred this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking pre-arrest bail.

On the strength of advance copy; Mr. Adhiraj Singh, AAG, Punjab causes appearance on behalf of the respondent-State. 4.

It is not in dispute before this Court that earlier the petitioner was extended the concession of anticipatory bail by this Court vide order dated 16.11.2022 passed in CRM-M-52791-2022 (Annexure P-2) and as per the pleaded cause of the petitioner, the need to file the petition in hand is arise on account of addition of Sections 304/325/323 of IPC and Section 181/192 of the Motor Vehicle Act. It is not the case of the State that the petitioner has misused the concession of anticipatory bail earlier extended to him. In view of the totality of the facts and circumstances of the case, the petition is granted, subject to the conditions as enumerated under Section 482(2) of BNSS.

This order should not be treated as "blanket" order. It will not be read granting petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence.

Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 482(2) of BNSS or upon showing any other sufficient cause.

Needless to say that anything observed herein above shall not be construed to be an opinion on the merits of the case. 9.
