**** HARNARESH SINGH GILL, J.(Oral) Through this petition, the petitioner seeks regular bail in case bearing FIR No.110 dated 01.10.2021, registered under Sections 420, 467, 468 and 471 IPC (added later on) and Sections 10 and 11 of the Prohibition of Child Marriage Act, at Police Station Ramdass, District Amritsar.

Learned counsel for the petitioner submits that the allegation against the petitioner is that he had forged his Aadhaar Card, which was used by him in a petition filed before this Court seeking protection, being a run away couple; that the protection petition had been dismissed as withdrawn and that now wife of the petitioner, namely, Amardeep Kaur, is at an advance stage of pregnancy. He further submits that the petitioner has been in custody since 03.01.2022.

Per contra, while opposing the prayer for grant of regular AMAN JAIN 2022.07.15 18:24 I attest to the accuracy and authenticity of this order/judgment

CRM-M-29055-2022 (O&M) -2bail to the petitioner, learned State counsel does not dispute the custody period of the petitioner. He, however, submits that investigation is still going on in the present case.

I have heard the learned counsel for the parties. The petitioner has been in custody since 03.01.2022. The allegation against the petitioner is of forging his own aadhaar card. Protection petition had been dismissed as withdrawn. Wife of the petitioner is at her advance stage of pregnancy. Investigation is till going on. In such circumstances, the trial of the case would take a long time to conclude. Therefore, no useful purpose would be served by keeping the petitioner behind the bars.

In view of the above and without commenting anything on the merits of the case, lest it should prejudice the case of either side, the present petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. 15.07.2022 (HARNARESH SINGH GILL) Aman Jain JUDGE Whether speaking/reasoned :
