NIDHI GUPTA, J. (ORAL) By way of filing the present revision petition, the petitioners have assailed the order dated 24.04.2019, passed by the learned trial Court, whereby they were charge-sheeted under Sections 306 and 304-B read with Section 34 IPC.
At the outset, on instructions from SI Ashok Kumar, learned counsel for the State submits that the instant revision petition has been rendered infructuous, as the petitioners have already been convicted and sentenced by the trial Court vide judgment dated 25.02.2022. Brother of petitioner No. 2 who is present in Court does not dispute the aforesaid fact and has placed on record a copy of order dated 17.01.2023, passed by a co-ordinate Bench of this Court in CRM-160352022 in CRA-A-343-2022, whereby the sentence of petitioner No. 2Rupak was suspended. In view of the above, the instant revision petition is disposed of as having been rendered infructuous.
