(ORAL ) This is a petition filed under Articles 226/227 of the Constitution of India, with a prayer to issue mandamus directing respondent Nos.1 and 2, to count the work charge/daily wages service rendered by the petitioner followed by his regular service taken as qualifying service for computation of pensionary benefits in view of the rules governing the conditions of service and further to extend the benefits granted in respect of similarly situated persons who had filed CWP-11081 of 2015, titled as RAJ KUMAR ARORA 2020.09.30 15:05 I attest to the accuracy and integrity of this document

Learned counsel for the petitioner has submitted that the petitioner is similarly situated and therefore, non-grant of benefits to the petitioner is arbitrary. He has further submitted that legal notice dated 24.7.2020 (Annexure P3), was sent to the respondents but the same has not been decided.

Notice of motion.

Mr.Jaipal Sandhu, Advocate, accepts notice on behalf of all the respondents and has stated that he has instructions to state that the legal notice dated 24.7.2020 (Annexure P3), served by the petitioner shall be decided within a period of next two months. In view of statement made by the learned counsel for the respondents, the present petition is disposed of with a direction that the legal notice dated 24.7.2020, (Annexure P-3), shall be decided by passing a speaking order within a period of two months in accordance with law and in case it is found that the petitioner is entitled to the benefits as prayed by him then the same shall be released to him within another period of one month thereafter.
