The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to grant pension and other pensionary benefits instead of Employees Provident Fund Scheme. 2.

The petitioner retired on attaining the age of superannuation on 30.04.1998. He was entitled to Employees Provident Fund at the time of his retirement which was released to him. In 2010, he realized that similarly situated employees have been granted benefit of pension instead of Employees Provident Fund Scheme, thus, he made representation dated 26.12.2010. Getting no response from respondent, he preferred instant petition before this Court.

Mr. Roopak Bansal, Advocate submits that respondent has granted claimed benefit to similarly situated employees, thus, case of petitioner needs to be considered.

On being confronted with order dated 07.07.2010 passed by this Court in CWP No. 225 of 2009, Mr. Raman Sharma, Addl. A.G., Haryana asserts that competent authority would consider claim of petitioner in the light of aforesaid order.

Counsel for the petitioner agrees to the aforesaid arrangement. 6.

In the wake of statement of both sides, the instant petition stands disposed of. Let the needful be done within six months from today. It is hereby made clear that legal representative(s) of the petitioner shall be entitled to differential amount, if any, from the date of filing of instant petition before this Court till the date of death of the employee. 7.
