R.P. Nagrath, J. (Oral) Learned State counsel has filed the response by way of affidavit of Sh. Surinder Singh, Superintendent, Central Jail, Ferozepur and the same be taken on record.

Learned State counsel submits that as per reply the petitioner is suffering from serious ailments as mentioned in the report attached with the reply.

The petitioner was granted parole upto 29.08.2015. When the notice of motion was issued, the period of parole was extended by this Court upto 03.09.2015.

The prayer for grant of parole could be considered only if the petitioner would have surrendered before the jail authorities.

As per reply, the petitioner was called for his chemotherapy sessions, which was postponed to 03.09.2015 in lieu of neutropenia.

No further indulgence of this Court is required as CRM No. 885 of 2015 in CRA-S-3373-SB of 2012 for suspension of JITENDER KUMAR 2015.09.07 12:30 I attest to the accuracy and integrity of this document

CRWP No. 1256 of 2015 -2sentence at the instance of petitioner is pending. The petitioner is directed to surrender before the jail authorities by 05.09.2015 with a further direction to Superintendent, Central Jail to ensure that proper medical care is provided to the petitioner.

The instant petition is disposed of with the aforesaid observations and directions.
