Prayer made in the present petition is for quashing the selection made under the Advertisement No.05/2007 and appointment vide order dated 13.03.2008 qua respondent No.4 to 21.

Learned State counsel, while referring to the preliminary submissions of the written statement, submits that during the pendency of the case, the petitioner was considered eligible under the said Advertisement, which he on the earlier occasion was not, however, his marks being 43.52 were found to be less than the last selected candidate, whose were 48.38. 3.

The above was not controverted by way of any replication or affidavit by the petitioner.
