The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondent to handover his vehicles bearing registration No.HR-91-D-3022 & HR-91-C-5575. He is further seeking direction to respondents not to auction or transfer the said vehicles.

As per petitioner, he is owner of the captioned vehicles. He had purchased said vehicle against loan, thus, there is hypothecation of respondent-Bank. He could not pay few of the EMIs pursuant to which the respondent-Bank on 16.04.2026 took away his tractors without any demand notice. He served representation dated 18.04.2026 upon the respondent-bank for release of the vehicles but to no avail. The petitioner claims that respondent-Bank has forcibly taken possession of the vehicle. The petitioner has remedy to approach Banking Ombudsman besides remedy to approach Civil Court because disputed question of facts is involved.
