* * * * Medical bills of Rs.1,13,818/-, which were marked as Ex.P-1 to Ex.P-77, were not considered on the ground that the doctor or physiotherapist or proprietor of the medical store had not been examined. This was no ground to discard the bills, as such, these bills were taken into consideration.

As agreed, as per statements of learned counsel for the appellants as well as counsel for the Insurance Company, separately recorded, a sum of Rs.3,50,000/- over and above the amount already awarded by the Tribunal, is awarded to the appellants. Learned counsel further submitted that the entire enhanced amount be paid to appellant No.1-Purshotam Hissaria S/o Gopi Ram for & on behalf of all the claimants, in full & final satisfaction of the claim. Accordingly, we dispose of this case with a direction to the Insurance Company to deposit cheque in the sum of Rs.3,50,000/- favouring appellant No.1 Purshotam Hissaria S/o Gopi Ram with the Office of the Lok Adalat of the High Court on or before 08.05.2023. Failing compliance of the order, interest @ 9% per annum shall follow on this MAMTA 2023.03.21 16:11 I attest to the accuracy and integrity of this order/judgment

FAO NO.4701 OF 2007 amount till payment from the date of this order. The appellants' counsel may collect the cheque/draft from the office of the Lok Adalat. The office shall retain the photocopy of the cheque/draft bearing signatures of the Counsel.

Appeal stands disposed of.

Copy of this order be supplied/sent to the counsel/parties and file be consigned to record.
