SANDHAWALIA, J.(Oral) The challenge in the present petition is to order dated 30.07.2019 (Annexure P-19), whereby the legal heir of deceased Balbir Singh is to be brought on record by way of a Will and the legal heir none other than the wife of the deceased, which has now been sought to be challenged in a petition filed under Article 227 of the Constitution of India. There is a dispute as such inter se the parties since there is a suit for specific performance (Annexure P-2) is also pending in which deceased was defendant No.2. The application which has been allowed is stated to be in eviction petition by one of the co-sharers namely Harmohinder Singh son of late Shri Lachhman Singh. 114 CR-1581-2021 -2Controller that too way back on 30.07.2019 i.e. 2 years back. This court is of the opinion that this petition is misconceived and is dismissed as such. Petitioners shall pay costs of Rs.10,000/- to be deposited with Poor Patients Welfare Fund, PGIMER, Chandigarh. In case, the receipt of payment of costs is not produced before the Rent Controller, the defence of the petitioners shall be deemed to have been struck off.
